Programmers Stack Exchange is a question and answer site for professional programmers interested in conceptual questions about software development. It's 100% free.

Not sure if this is the right forum. If it's not, please let me know and I'll move it.

So I have been asked by a client to develop a RoR Web App for them. He asked me if the development is their property. I said yes, you can request the source code and database migrations anytime.

Then he says "I'm asking you this, because we plan to resell the app to other branches. That's why I'm asking you if the development is ours and we have rights to resell it." So I'm thinking they do. I mean, they paid me to program for them.

Is there a recommendation from any of you more experienced programmers? I'm thinking about of course, telling him he has the right to resell it, and I could help him deploying the app in more servers and cut him a web hosting deal so I can also benefit from my app being resold. What do you guys think?

can depends of your contract or country –  shingara Feb 21 '12 at 16:55
Take a copy of your contract to a lawyer. In the US, 99% of the time the answer will be "yes, they own the right to resell". –  Paul Tomblin Feb 21 '12 at 16:58
Not a good place for legal advice. I would suggest getting a lawyer to look over things, but unless something funny is going on then they should have the right to resell it. –  Josh K Feb 21 '12 at 17:19

I'm not a lawyer so don't take my words without checking them out.

The copyright of the code is completely salable and I think, as @Pau Tomblin has said, 99% of the possibilities that your actual contract is already telling that you are selling the copyright of your code to your employer.

About if you should ask more money because the code is gonna be reseled: I don't this so.

About if you should ask more money for any new integration: of course.
