1.: No. There is no contract between Freddy and Acmesoft, only between (Eddie and Freddy) and (Acmesoft and Betty). Freddy can request the source from Eddie, and Eddie from Dave, ... and Betty from Acmesoft. I seriously doubt that these contracts are transitive - but IANAL.

@AndrewMarshall: "Although the report identified a software bug as the direct cause, other investigators see the causes as system design failures and management issues" - I seriously doubt that code written in a different language (e.g. Java or C++) would have gotten the rocket to orbit.
