In Java, which I know is not directly relevant (hence a comment, not an answer) the better IDEs can perform this refactoring (Introduce Factory method) automatically when required. Hence it is trivially easy to introduce this extra complexity for those few occasions when it is required.

In java, at least, you have to typically enable the assertion check with the -ea command line parameter. This means assertions are effectively no-ops, unless you explicitly turn them on.
